Agreement
This agreement is made between Greater MPower Tutoring, llc, referred to as the “Provider”, and the student, referred to as the “Student”. If the student is under the age of eighteen, then this agreement is between the Provider and the parent or legal guardian of the student, referred to as the “Parent”. If the student is under the age of eighteen, the Parent agrees to this contract on behalf of the student, and further agrees to enforce the Student’s compliance with the terms of this contract. By making payment to the Provider, the Student and Parent, as applicable, agree to all of the terms of this contract.
Cancellations
WITHDRAWAL OF STUDENTS
The Student may be withdrawn from the clinic with written notice and without financial penalty prior to May 28, 2023, at midnight ET. Withdrawals between May 29, 2023, and June 12, 2023, will be refunded 50% of the price paid for the clinic. Withdrawals on and after June 12, 2023 are not eligible for a refund of any amount. The Student will not be refunded any amount for their absences, planned or unplanned.
CANCELLATION OF CLINICS BY THE PROVIDER
In exceptional circumstances, a lesson may have to be cancelled and rescheduled, in which case the Provider will give as much notice to the Student as possible.
Nondisclosure of Confidential Information
The Student and Parent, as applicable, will not disclose any confidential information related to the Provider, including but not limited to company service strategies, operations, systems, techniques, marketing plans and tactics, private and commercial contacts, clients, tutors, contracts, financial matters, or expansion plans.
Confidential information is defined as any information that is generally unknown to individuals who are not the Provider’s personnel. The Student and Parent, as applicable, also agree not to disclose any confidential information for three years after the termination of this agreement.
Dispute Resolution
All matters and any disputes hereunder shall be governed by and construed in accordance with the substantive laws of the State of Georgia, without regard to its conflict of law provisions. The Parties to this agreement hereby consent to the personal and exclusive jurisdiction and venue of the Georgia state courts. In the event of a dispute, the Provider, its Representatives, and the Student and Parent, as applicable, agree to participate in all available alternative dispute resolution mechanisms offered by the courts. The Provider will not be responsible for the legal fees of the Student or Parent, as applicable, even if the Student or Parent, as applicable, prevails in any dispute.
